Terms of Service

Welcome to Toe Reading (in Dutch: Tenenspiegel), a web app for playful self-reflection through the shapes of your toes. These terms are a plain-language agreement between you and us. By creating an account or using the app, you agree to them.

1. Who we are

Toe Reading is operated by Ferri Somogyi Productions, a sole proprietorship registered in the Netherlands (Chamber of Commerce / KvK no. 34286815, VAT ID NL001933433B06). Contact: support@toereading.app. Registered address available on request.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: Paddle is legally the seller of the purchase, handles payment, VAT/sales tax, invoices and refund processing, and provides related customer service.

2. What Toe Reading is — and is not

Toe Reading is for entertainment and self-reflection only. It is not a medical, psychological, diagnostic or therapeutic service, and its readings are not advice of any kind. Nothing in the app can detect, diagnose, treat or predict any health condition. If you have concerns about your feet or your health, please see a doctor or qualified professional.

The app lets you photograph your feet, classifies visible features of your toes, and generates a reflective, narrative "reading" with the help of AI (Anthropic's Claude). Readings are generated text: treat them as a mirror for your own reflection, not as facts about you.

3. Your account

You need an account (name, e-mail, password) to run readings. You must be 16 years or older. Keep your login details safe; you are responsible for activity on your account. Provide accurate information and keep it up to date. One account per person, please.

4. Credits and subscriptions

Readings run on credits ("analyses"):

One credit covers one complete reading: the photo analysis plus the full interpretation ("The mirror speaks"). Credits are personal, non-transferable and cannot be exchanged for money. Current prices are always shown on our pricing page; all consumer prices include VAT where applicable.

5. Payments, renewal and cancellation

Payments are processed by Paddle (see section 1). The annual subscription renews automatically each year at the then-current price; you will receive a reminder e-mail before renewal. You can cancel at any time via the link in your Paddle receipt or by e-mailing support@toereading.app — cancellation stops the next renewal, and your subscription stays active until the end of the paid term. We may change prices for future purchases and renewals; we will announce changes before they affect you.

6. Refunds

Our Refund Policy applies: in short, a full refund within 14 days as long as the purchased credits have not been used. Your statutory rights as a consumer are never limited by these terms.

7. Your photos

Photos you submit are used solely to perform the reading you requested. They are transmitted encrypted, never stored, and not used to train AI models. Only submit photos of your own feet, or of someone who has given you permission. See our Privacy Policy for details.

8. Fair and acceptable use

Please don't: use the app for anything unlawful; submit images that are not feet or that are unlawful or harmful; attempt to bypass credit checks, rate limits or other technical measures; use bots or automated access; resell readings as a commercial service without our written agreement; or reverse-engineer the service. We may apply technical limits (such as rate limits) to keep the service healthy, and we may suspend accounts that abuse it.

9. Intellectual property

The app, its knowledge base, texts, design and software are ours (or our licensors'). You may use your personal readings freely for your own purposes. You may not copy or republish the app's content or knowledge base at scale.

10. Availability and changes

We run Toe Reading with care, but offer it "as is": we cannot promise uninterrupted availability. Some languages are marked beta. We may improve, change or discontinue features; if we ever discontinue the paid service, we will refund unused paid credits and the unused part of subscriptions.

11. Liability

To the extent permitted by law, our total liability for any claims related to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect damages. Nothing in these terms excludes liability that cannot legally be excluded (such as for intent or gross negligence).

12. Changes to these terms

We may update these terms. For meaningful changes we will notify you in the app or by e-mail before they take effect. If you keep using the service after that, the new terms apply.

13. Governing law

Dutch law applies. Disputes go to the competent court in the Netherlands; if you are a consumer, mandatory consumer protections of your country of residence remain unaffected.

Algemene voorwaarden

Welkom bij Toe Reading (in het Nederlands: Tenenspiegel), een web-app voor speelse zelfreflectie via de vormen van je tenen. Deze voorwaarden zijn een afspraak in gewone taal tussen jou en ons. Door een account te maken of de app te gebruiken, ga je ermee akkoord.

1. Wie wij zijn

Toe Reading wordt aangeboden door Ferri Somogyi Productions, een eenmanszaak gevestigd in Nederland (KvK-nummer 34286815, btw-id NL001933433B06). Contact: support@toereading.app. Vestigingsadres op verzoek beschikbaar.

Onze bestellingen lopen via onze online reseller Paddle.com. Paddle is de Merchant of Record: juridisch de verkoper van je aankoop. Paddle verzorgt de betaling, btw, facturen en de uitvoering van terugbetalingen, en biedt daarbij klantenservice.

2. Wat Toe Reading is — en niet is

Toe Reading is uitsluitend bedoeld voor entertainment en zelfreflectie. Het is geen medische, psychologische, diagnostische of therapeutische dienst, en de duidingen zijn geen advies. Niets in de app kan een gezondheidsprobleem vaststellen, behandelen of voorspellen. Zit je ergens mee — met je voeten of je gezondheid — ga dan naar een arts of een gekwalificeerde professional.

Met de app fotografeer je je voeten, worden zichtbare kenmerken van je tenen geclassificeerd en wordt met behulp van AI (Claude van Anthropic) een verhalende "lezing" gegenereerd. Lezingen zijn gegenereerde tekst: zie ze als een spiegel voor je eigen reflectie, niet als feiten over jou.

3. Je account

Voor lezingen heb je een account nodig (naam, e-mail, wachtwoord). Je moet 16 jaar of ouder zijn. Houd je inloggegevens veilig; jij bent verantwoordelijk voor wat er met je account gebeurt. Vul juiste gegevens in en houd ze actueel. Eén account per persoon, graag.

4. Tegoed en abonnement

Lezingen werken met tegoed ("analyses"):

Eén tegoed dekt één complete lezing: de foto-analyse plus de volledige duiding ("De spiegel vertelt"). Tegoed is persoonlijk, niet overdraagbaar en niet inwisselbaar voor geld. Actuele prijzen staan altijd op onze prijzenpagina; alle consumentenprijzen zijn inclusief btw waar van toepassing.

5. Betalen, verlenging en opzeggen

Betalingen verlopen via Paddle (zie punt 1). Het jaarabonnement verlengt automatisch per jaar tegen de dan geldende prijs; je ontvangt vooraf een herinneringsmail. Opzeggen kan altijd via de link in je Paddle-bon of per mail aan support@toereading.app — opzeggen stopt de volgende verlenging en je abonnement blijft actief tot het einde van de betaalde periode. Prijzen kunnen wijzigen voor toekomstige aankopen en verlengingen; we kondigen dat aan vóór het jou raakt.

6. Terugbetalingen

Ons terugbetalingsbeleid geldt: kort gezegd volledige terugbetaling binnen 14 dagen zolang het gekochte tegoed niet is gebruikt. Je wettelijke rechten als consument worden door deze voorwaarden nooit beperkt.

7. Je foto's

Foto's die je instuurt worden uitsluitend gebruikt voor de lezing die je aanvraagt. Ze worden versleuteld verstuurd, nooit opgeslagen en niet gebruikt om AI-modellen te trainen. Stuur alleen foto's in van je eigen voeten, of van iemand die je daarvoor toestemming gaf. Zie onze privacyverklaring voor de details.

8. Eerlijk en toegestaan gebruik

Doe alsjeblieft niet: de app gebruiken voor iets onwettigs; afbeeldingen insturen die geen voeten zijn of die onrechtmatig of schadelijk zijn; tegoedcontroles, snelheidslimieten of andere technische maatregelen omzeilen; bots of geautomatiseerde toegang gebruiken; lezingen commercieel doorverkopen zonder onze schriftelijke afspraak; of de dienst reverse-engineeren. We mogen technische limieten toepassen (zoals rate limits) om de dienst gezond te houden, en accounts schorsen die misbruik maken.

9. Intellectueel eigendom

De app, de kennisbank, teksten, het ontwerp en de software zijn van ons (of onze licentiegevers). Je persoonlijke lezingen mag je vrij gebruiken voor eigen doeleinden. Het is niet toegestaan de inhoud of kennisbank van de app op grote schaal te kopiëren of te herpubliceren.

10. Beschikbaarheid en wijzigingen

We draaien Toe Reading met zorg, maar bieden het "as is" aan: ononderbroken beschikbaarheid kunnen we niet beloven. Sommige talen zijn gemarkeerd als bèta. We kunnen functies verbeteren, wijzigen of stopzetten; mochten we de betaalde dienst ooit stoppen, dan betalen we ongebruikt betaald tegoed en het ongebruikte deel van abonnementen terug.

11. Aansprakelijkheid

Voor zover wettelijk toegestaan is onze totale aansprakelijkheid voor claims rond de dienst beperkt tot het bedrag dat je ons in de 12 maanden vóór de claim hebt betaald. We zijn niet aansprakelijk voor indirecte schade. Niets in deze voorwaarden sluit aansprakelijkheid uit die wettelijk niet uitgesloten kan worden (zoals bij opzet of grove nalatigheid).

12. Wijziging van deze voorwaarden

We kunnen deze voorwaarden bijwerken. Bij betekenisvolle wijzigingen informeren we je in de app of per e-mail vóór ze ingaan. Gebruik je de dienst daarna nog, dan gelden de nieuwe voorwaarden.

13. Toepasselijk recht

Nederlands recht is van toepassing. Geschillen gaan naar de bevoegde rechter in Nederland; ben je consument, dan blijven de dwingende consumentenbeschermingen van je woonland gelden.
